Elderly man accused of raping mentally challenged neighbor

A MAN in his sixties has been arrested on suspicion of raping a mentally challenged young woman in Shanghai's Pudong New Area.

The 63-year old suspect surnamed Chen was taken into custody on July 29 after a neighbor who refused to be identified called police when Chen was again attempting to coax the woman into his apartment, Oriental Morning Post reported today.

The neighbor grew suspicious of Chen after having seen him lead the mentally disabled woman into his apartment several times.

"There were rumors about their unusual relationship," the resident was quoted as saying in the report.

He also stressed to police that the woman was incapable of protecting herself.

The residential committee of the complex agreed with the neighbor's suspicion as they said Chen and the woman had taken free condoms from the family planning office in the complex.

Chen's wife died of cancer three years ago. The 26-year old alleged victim moved into Chen's complex three years ago.

According to the complex's residential committee, it was not clear when Chen and the alleged victim became acquainted.

They may have had a sexual relationship for quite a long time as the woman has "a history of abortions," the report cited the residential committee as saying.

Chen's next-door neighbor surnamed Yan told the newspaper she has never seen the two together and that Chen is "a little nice guy."

According to China's law, Chen will be charged with rape if it is established they had sex and it is established that the woman is mentally challenged and incapable of protecting herself. The rape charge applies regardless of whether the victim consented to having sex.

The case is still under investigation.
