Man paying millions to find 'pure, sweet young lady' gets partial refund from dating firm failing to please

A local matchmaking agency was ordered to return 4-million-yuan (US$644,800) service fee to a man who paid it 7 million yuan for seeking an ideal partner but was unsatisfied with all the eight female candidates it had arranged him for dating, the Shanghai No.1 Intermediate People's Court said Thursday.
The appeal court said the man in his 40s, surnamed Zhang, signed a contract with the agency in December, 2009 for a matchmaking service.
According to the contract, the agency should arranged some romantic parades and press conferences in seven cities, including Shanghai, Beijing and Guangzhou, for promotion. The women he wants to date should be pure and sweet young ladies aged between 20 and 28, with a height of 165 to 173 centimeters.
The agency also promised that if Zhang didn't find the right person in two years, it will return part of the payments to him.
Then the agency posted ads both online and offline across the country and held events in several cities, as well as interviewing the applicants with some experienced marriage counselors and psychological counselors. It even set up a database for all applicants.
However, Zhang still failed to get a girlfriend after all these efforts, which cost him about 7.06 million yuan.
Since the agency refused to refund him, Zhang filed a lawsuit to a local court in March last year.
In court Zhang alleged that the service had failed and he was not sure if all the money he paid the agency had been used for his project.
But the agency showed judges a report issued by an accounting firm which proved that it did used nearly 5 million yuan on Zhang and based on their contract, it only needs to pay him 1.3 million yuan.
The court of first instance ruled the agency to pay Zhang 1.3 million yuan. Zhang was unsatisfied with the ruling and later appeal to the Shanghai No.1 Intermediate People's Court.
The court finally ordered the agency to pay back 4 million yuan to Zhang.
