Compensation for family after man dies on Metro

SHANGHAI Metro operator has been told to pay 160,000 yuan (US$25,120) to the family of a commuter who fainted on a train and later died. The Shanghai Railway Transportation Court ruled that the operator had failed to rush the man to the hospital in time.

On March 2, Chen Jian, the 33-year-old man, fainted on a train arriving at Jiangwan Town Station on Line 3. The station staff checked him and advised the control room to alert the next station, Dabaishu Station, about the emergency.

The court said it led to a three-minute delay in its emergency efforts that could have been avoided. Chen died in hospital later. The cause of his death was listed as heart attack.

Chen’s family filed a lawsuit against Shanghai Shentong Metro Group and said it should pay 840,000 yuan — half of the 1.6 million yuan they calculated as compensation.

The court said even though Chen fainted on the Metro it was not caused due to transportation. When the Metro staff checked on Chen, they notified the emergency center that fulfilled its obligation.

But the court faulted the operator for failing to rush Chen to a hospital in Jiangwan Town itself. The delay in rushing him to the hospital was what it had to bear — in this case, 10 percent of the compensation amount, or 160,000 yuan.

It is believed that the Metro operator did not want to hold back the train at Jiangwan Town to avoid delaying the following trains.

A Metro official surnamed Xu told Shanghai Daily that the staff are supposed to inform the emergency medical center and, if possible, take simple measures before an ambulance arrives. But Xu admitted that their first aid skills were very minimal and basic.

Liu Qingchun, a lawyer, said the ruling will push the Metro operator to address its emergency response measures.

Last year, the Shenzhen Metro operator had to pay 310,000 yuan as compensation after the death of a commuter. The woman collapsed on the station but the Metro staff were found wanting in its efforts. When the ambulance arrived the woman was already dead.
