4 told to pay over woman’s death in fire
A COURT yesterday ordered a house owner and three tenants to pay the family of a woman killed in a night-time fire in the Pudong New Area two years ago a total 1.45 million yuan (US$214,567).
The local fire department said the blaze was probably caused by an electrical problem with three electric bikes parked in the house, belonging to the three tenants, the Pudong New Area People’s Court said yesterday.
The house owner, surnamed Bao, was ruled to pay more than 430,000 yuan and the tenants were ordered to pay the remaining 70 percent.
The court said the victim, surnamed Xu, was living with the tenants, Zhao, Cai and Yu, in a three-floor house in Tangzhen on September 24 in 2015.
The ceiling of the third floor collapsed in the fire, killing Xu.
Xu’s family filed a suit against the house owner and the tenants in February last year.
Her family argued Bao had a duty to manage and maintain the security of his house and the other three also shared the blame.
But Bao said the main cause of the fire was likely to be the tenants’ electric bikes and his responsibility was only secondary.
The tenants argued the cause of the fire had not been proved and may not have been any of their bikes.
But the court based its judgement on the fire department’s report which said the source of the blaze was where the bikes were parked and that there was no evidence of an outside cause. The court said Bao should also take some responsibility.
