Carrot and stick regulation for street food vendors

ILLEGAL street food vendors are getting a break — if they don’t step out of line.

A draft regulation by Shanghai Food and Drug Administration offers a solution for food vendors who are popular with the public but who have failed to obtain an eatery license.

They can stay in business without a license for no more than three years as long as they register with local neighborhood authorities. However, they cannot sell banned food such as the type of clam that caused an outbreak of hepatitis A in Shanghai in 1988.

Those who sell “highly risky” food such as raw aquatic products, cold dishes and pastry, and those who produce cooking odors and bother local residents are also excluded, according to the draft.

Other requirements that the vendors must follow include: setting up their stalls in a fixed building; being at least 25 meters away from any public toilet, cesspool and garbage field; not having livestock and poultry on site; and not living on site.

If they meet all the stipulated requirements, they can register to run their business without a license for one year. That registration can then be renewed for the following two years.

Nonetheless such neighborhood registration is a temporary policy and once the three years are up, such vendors must either shut down their operations or obtain an eatery license.

If they violate any rules during the “grace period” such as being involved with fraud or bribery, they will be closed down immediately and face further punishment, the draft said.

It has been published to seek the public’s opinions, which need to be made by March 10.

According to Yan Zuqiang, the director of Shanghai Food and Drug Administration, the ultimate goal is that all small food businesses operate with an official license.
