Court accepts first local lawsuit against Samsung over exploding battery of Galaxy Note 7
SAMSUNG has been sued by a local resident who alleged a newly-bought Galaxy Note 7 phone exploded at home, burning bedding and mattress.
The Jinshan District People’s Court has accepted the lawsuit, which is considered the first case filed against Samsung over exploding batteries in Shanghai.
The user surnamed Yao is demanding nearly 24,000 yuan (US$3,550) from the maker Samsung’s joint venture in Huizhou City in Guangdong Province, and the seller Shanghai Yuanmai Trade Company, subsidiary of China’s leading B2C shopping website JD.com, court said.
Yao said he saw a notice from Samsung, which said the battery of Galaxy Note 7 sold in Chinese mainland was different and safe, and he made the order from Yuanmai via JD.com on September 7, court said.
He said he received the phone the next day. But just ten days later, the 5,988-yuan phone allegedly vibrated and smoked when he was using it on the bed. Shocked, he threw it to the bed, at which point it blew up, emitting odor and leaving phone-size burns on bedding and mattress, he told the court.
Yao filed against the South Korean company and also JD’s subsidiary to Jinshan Court on October 11, the day when Samsung announced to recall a total of 190,984 Galaxy Note 7 on domestic shelves.
He said Samsung lied about the phone’s safety, and Yuanmai still sold it despite of its safety hazards. He wanted the refund of 5,988 yuan, and another 17,964 yuan, three times the price, as compensation, court said.
Court didn't says when it will hear the case.
