Court orders mistress to pay back lover’s wife
A MISTRESS was ordered to pay more than 1 million yuan (US$163,400) back to a woman who discovered her husband had given the money to his lover for “living expenses,” Yangpu District People’s Court said yesterday.
The plaintiff, surnamed Jin, sued Yang, the mistress, in March after discovering her husband was having an affair with the woman. In the lawsuit, Jin demanded the couple’s marital property be returned.
The court heard Yang was a college student when she met Jin’s husband at a friend’s party in May 2009. The pair soon developed a relationship.
Between October 2009 and February of this year, Jin’s husband gave Yang more than 1 million yuan in 82 installments, the court heard.
Jin and her husband have been married for 10 years and have two children. She didn’t learn about the affair until March. Jin’s husband admitted giving the money to Yang during the hearing.
However, Yang argued she was a victim because she didn’t know her boyfriend was married until early this year. She refused to give the money back as she said it was a gift and was used for living expenses, the court heard.
The court disagreed. It ordered Yang to return all the money to Jin, saying it belonged to the couple.
