Court urges mediation in dispute

THE Jing'an District People's Court has deferred a ruling and has asked the plaintiff and defendants in a compensation case to mediate.

The family of a 64-year-old American, who died due to gas poisoning in 2011, is seeking 1 million yuan (US$163,000) in compensation from the owner of the apartment, the gas company and the real estate company.

William J. Tuochy died of carbon monoxide poisoning in his room on October 11, 2011. The apartment where he lived on Xinzha Road was rented by his company from the owner Liu Ping.

Improper installation and an old gas hose was blamed for the gas leakage that killed Tuochy in his sleep.

Tuochy's family filed a lawsuit at the Jing'an District People's Court on April 23, 2012, demanding 4-million-yuan compensation.

But following previous court mediation, Tuochy's family agreed to lower the compensation amount to 1 million yuan but the issue remained unsettled.

At yesterday's hearing, the plaintiff said they were willing to bring down the compensation amount to 800,000 yuan, but the defendants were only willing to pay 300,000 yuan.
