Cyclist’s compensation bid rejected

A COURT rejected a cyclist’s claim for 160,000 yuan (US$26,432) compensation from a moped rider he said knocked him down.

The 32-year-old moped rider, surnamed Pang, said he helped the 54-year-old cyclist, surnamed Qiu, get to his feet.

But Qiu claimed Pang struck  him on Hongmei Road in April, 2012.

Qiu fell from his bicycle and suffered fractures to his arm and leg. These resulted in medical bills of 40,000 yuan.

Qiu brought the case to the Minhang District People’s Court, demanding compensation totaling 160,000 yuan.

But the court said there was no evidence to show that any collision took place.

It said there was no surveillance camera footage nor witnesses who could prove Pang hit Qiu.

The only evidence, the court heard, were two statements by traffic police. These said that Pang’s moped didn’t collide with Qiu’s bicycle and that marks on Qiu’s trousers were not caused by Pang’s moped.
