Family wins compensation from scenic spot operator

THE operator of a scenic area in neighboring Zhejiang Province was ordered by a local court to pay more than 230,000 yuan (US$37,096) as compensation to the family of a Shanghai tourist who died while trying to save his son who had fallen from a steep path.

The incident happened in August last year when the man surnamed Zhang tried to save his son but fell into a gully at Wuxie Scenic Area, which is known for waterfalls.

The son had slipped off a stairway as they climbed a steep slope.

Zhang fell on a rock below and died at the hospital, while his 3-year-old son suffered head injuries. The family was on a two-day trip organized by Zhang’s company.

Zhang’s family filed a lawsuit against the Shanghai travel agency that organized the tour and the management company of the scenic spot, at the Changning District Court in December.

They accused them of failing to take necessary safety measures and demanded 1.2 million yuan compensation.

Judge Hou Xinlin said the Wuxie operator should bear the responsibility for Zhang’s death as the wide gap on handrails in the scenic spot posed safety hazards.

Zhejiang safety supervision authorities have ordered the operator of Wuxie to fix the handrail and narrow the gap after the incident.

The travel agency was exempted because the tourist guide had warned tourists about the dangers before and during the tour and handled the aftermath of the incident in a timely manner, the judge said in his ruling.
