Hospital pays for botched operation
A WOMAN who was sterilized at a hospital in Songjiang District won compensation of 13,000 yuan (US$2,095) after she became pregnant and faced a fine for violating the country’s family planning policy, Songjiang District People’s Court said yesterday.
According to the court, the woman, surnamed Fan, had a son and gave birth to a baby girl in a hospital, which wasn’t named, after the city allowed couples to have a second child. To prevent becoming pregnant again she had sterilization surgery in the same hospital.
However, Fan learned she was pregnant again when she felt sick and saw a doctor earlier this year. Fan and her husband then sought an abortion but was told it was too risky in her case.
The couple would owe a hefty fine for violating the family planning policy if having another child. She blamed the hospital and sued for compensation.
The two sides finally agreed on 13,000 yuan compensation after court organized mediation.
The court did not say whether Fan later had the baby.
In Shanghai, local parents of an “illegal” baby under the family planning policy need to pay a fine equal to triple the city’s average annual income as a “social upbringing fee” before the child can be registered as a permanent resident.
