Huangpu director defends home sale

THE director of Huangpu District appeared in court yesterday as the defendant in a case brought by a member of the public seeking to prevent local authorities from seizing his home.

The plaintiff, surnamed Xie, said the district government had no right to acquire his property as it is sited on land owned by an urban construction corporation and the Huangpu land reserve center.

He therefore decided to sue the district government and the director of the housing management bureau, the Huangpu District People’s Court heard.

The case was the first of its kind following a central government ruling issued on March 1 stating that executives of local administrative organs should appear in court to defend cases filed against them by members of the public.

District Director Peng Song said it was the first time he had been a litigant in court.

Unfortunately for Xie, the court rejected his appeal and deemed the compulsory purchase legal.

Most of his neighbors had already agreed compensation deals, the court said.
