Jeweler鈥檚 鈥榳anted poster鈥 libelous
A JEWELER has been warned that he is breaking the law by putting up “wanted posters” of a suspected thief around Xuhui District.
The shop owner, surnamed Zhou, says that a thief stole items worth tens of thousands of yuan from his store on Damuqiao Rd last week.
Zhou has posted about 300 notices on Xuhui streets featuring a still of a woman he claims is the perpetrator, taken from surveillance camera footage last Thursday.
The poster features a young woman dressed in white, together with the Chinese characters for “thief”, a description of the stolen items, Zhou’s mobile phone number and the emergency services number 110.
But Liu Xianquan, law professor at the East China University of Political Science and Law, yesterday said that Zhou has no right to do this. He said the poster is libelous, infringing the woman’s legal right to a reputation.
“Even if the woman proves to be the thief, he has no right to publish her picture until she’s convicted,” Liu said.
But Zhou told Shanghai Daily yesterday that he believes he has nothing to worry about.
“I don’t think I’ll run into legal trouble for posting the notices because I’m 100 percent sure that the woman is the thief,” he said.
Police told Shanghai Daily that the wanted posters could hamper their investigation, but had yet to speak to Zhou about this.
