Jinshan court to hear ‘exploding Note 7 phone’ case
SAMSUNG has been sued by a Shanghai resident who claimed a newly bought Galaxy Note 7 phone exploded at his home, burning bedding.
The Jinshan District People’s Court has accepted the lawsuit, which is described as the first filed in Shanghai against the South Korean company over exploding batteries.
The user surnamed Yao is demanding nearly 24,000 yuan (US$3,550) from the maker Samsung’s joint venture in Huizhou City in Guangdong Province, and the seller Shanghai Yuanmai Trade Company, a subsidiary of China’s leading B2C shopping website JD.com, the court said.
Yao said he saw a notice from Samsung, stating Galaxy Note 7 batteries sold on the Chinese mainland were safe, and as a result he had ordered a Note 7 device from Yuanmai via JD.com on September 7.
He received his phone the next day, but 10 days later, the 5,988 yuan device allegedly vibrated and then exploded when he was using it on the bed.
Yao filed the suit against the South Korean firm and JD’s subsidiary to Jinshan Court on October 11, the day Samsung announced a recall of all unsold 190,984 Galaxy Note 7 phones on China’s mainland.
Yao considered that Samsung had cheated him about the phone’s safety, and Yuanmai had still sold it despite it being hazardous, the court said.
Yao wanted a full refund and a further 17,964 yuan as compensation, the court added.
No date to hear the case has yet been announced.
