Karaoke house held responsible for death
A 13-year-old boy’s family was awarded 200,000 yuan (US$30,887) compensation from a karaoke house after the boy drank alcohol on the premises and later drowned in a nearby river, the Jiading District People’s Court said yesterday.
The karaoke house was blamed for his death because it sold minors alcohol and allowed them to drink it on the premises, the court said.
According to the court, the victim went to a local karaoke house in Jiading District with six friends on May 1 last year. The house stated on a notice in the lobby that it did not allow minors on the premises, but it still let the seven middle school students in and gave them a room. They then bought alcoholic beverages at a supermarket owned by the house and drank in the room.
After they left, they went to a nearby park and walked along the riverbank. However, the boy, who was drunk, climbed over the barrier and jumped into the water. His friend called the police after failing to rescue him, and he was confirmed dead after being pulled from the river.
The boy’s parents filed a lawsuit against the karaoke house and the park, demanding compensation.
The parents claimed the house broke the law by allowing juveniles to drink on the premises and that the park was partly responsible because it failed to put warning signs on the riverbank.
In its defense, the karaoke house said there was no evidence that the victim got drunk on the premises and that the boy was to blame for his own death by jumping in the river.
The park told the court that it had met its public safety obligations by erecting warning signs and fences in the park and along the river, insisting that the parents were to blame for not adequately supervising their child.
The court held the karaoke house responsible because it sold minors alcohol and gave them a place to drink it.
As for the park, the court ruled that it had done all it could to make it safe for the public and should not be held responsible.
The court agreed with the karaoke house that the parents should have better supervised their child, but ruled that it was also responsible, awarding the parents 200,000 yuan for economic loss and mental suffering.
