Legislator wants the kids put first in divorce cases
LOCAL legislators in the National People’s Congress want to change China’s Marriage Law to better protect the interests of children in divorce cases.
The proposal would see divorce proceedings delayed if the children were about to sit high school or college entrance exams, said legislator Yao Haitong who tabled the motion.
It also calls for courts to deny the divorce if the children are seriously ill or could not live an ordinary life after the split. It would also require a trial period to see how the divorce would affect children if they were under 10.
The proposal has the support of dozens of other legislators.
Yao said the existing law focuses on the husband and wife, but ignores the impact on their children. It calls for divorce certificates to be issued without delay after appropriate arrangements have been made for children and splitting property.
But Yao says divorcing couple focus too much on splitting property, so he wants it changed to protect children.
He said legislators have conducted inquiries in local communities and found an increasing number of young couple in Shanghai are seeking divorce while their children are still young.
“Many of them don’t regard divorce as a matter of any importance, nor do they consider the great impact it has on their children,” Yao said, adding his proposal would increase social stability.
The proposed change would also give more visiting rights to grandparents.
