Local hotel paid 645,000 yuan to couple whose son died after falling down from running machine at its gym

THE family of a 28-year-old man who died of a brain damage after falling down from a running machine at a hotel won a 645,000 yuan (US$98,620) compensation from the hotel, the Xuhui District People's Court said.

The man, an IT worker on a business trip to Shanghai, checked in at a local hotel, which is not named, at 9pm on May 9 last year and was found dead in the hotel's gym one hour later. After an autopsy, police said he died of a brain damage after he fell down from the running machine, injured his head and didn't receive a timely treatment.

After having a funeral of their son in his hometown of Hebei Province, the man's parents came to the Shanghai to demand a compensation for their son's death.

However, since they couldn't reach an agreement with the hotel on the amount of compensation, they brought a lawsuit against the hotel to the court, demanding a compensation of 1.45 million yuan.

The court said the hotel should be blamed for this incident because it should ensure its customer's safety when he was using the fitness equipment in its gym. But since the man is an adult who can be responsible for his act, he should also take responsibility for his own safety. So the court ordered the hotel to pay about 645,000 yuan to the victim’s parents.
