Lu Xun’s relatives lose copyright suit

FOUR grandchildren of Lu Xun, one of the best-known Chinese writers of the 20th century, yesterday lost their lawsuit against a publishing firm and the author of a book about their late relative.

The plaintiffs claimed “Biography of Lu Xun’s Portraits” by Huang Qiaosheng, deputy director of Beijing Lu Xun Museum, and published by Guizhou People’s Press, used 114 photos of their grandfather without permission.

They demanded a public apology and 70,000 yuan (US$11,450) compensation.

The Huangpu District People’s Court, however, ruled against the plaintiffs saying the photographs used in the book were now in the public domain, and therefore neither the author nor the publishing house had infringed their copyright.
