Murder victim's kin wins damages

AN underground car park owner and its property manager were yesterday ordered to pay 201,724 yuan (US$29,539) in compensation for the death of a woman who was stabbed there by a supermarket cleaner.

Jiading District People's Court made the decision in the wake of the tragedy involving Lu Qingqing.

Lu drove a car to a supermarket in Jiading District on April 28, 2007, and parked the vehicle on the second basement level.

When she finished shopping, Lu lost her way and asked cleaner Zhou Wei for help in finding her car.

Zhou, an Anhui Province native, saw that Lu was well dressed and immediately decided to rob her.

Zhou led Lu to a dim passage and when she resisted his robbery attempt, he fatally stabbed her.

Zhou was sentenced to death in March 2008 and was executed in October 2008.

Lu's family sued the supermarket, a city real estate company that owned the car park, the car park management company and the cleaning company that sent Zhou to the supermarket, seeking more than 860,000 yuan in compensation.

The plaintiffs said the supermarket and the cleaning firm were negligent.

The real estate company and the property manager failed to adequately protect customers and had too few security guards in the big car park, the court heard.

All defendants said the victim's family should seek compensation from Zhou.

The real estate firm said it had security measures and cameras but could not guarantee the safety of all property and people in the car park.

The court decided the car park owner and its property manager should bear responsibility but the other two were exonerated.

The real estate company made a mistake since it put the car park into use before it passed security tests and the surveillance system there did not cover the entire area.

The property manager had only one security guard for the entire car park, the court said.
