'New' car had undergone repairs

A CAR sales company has been ordered to compensate a customer who discovered his "brand-new" Honda had been resprayed and had dents beaten out.

The company, which was not named, was told to pay 20,000 yuan (US$3,175) to the customer, surnamed Bi, the Xuhui District People's Court said yesterday.

Bi said he paid 233,800 yuan for a "new" Honda Spirior in August 2010.

But Bi said when he put the car in for maintenance, he learned that dents had been beaten out of some panels and the areas then resprayed, the court heard.

The car company said that Bi's car had been damaged by stones, but argued it met standards for new cars. It said it gave Bi a 32,000 yuan discount on the list price.

The court ruled the company must pay Bi 20,000 yuan, saying it had committed a partial breach of contract by concealing the car's true status.
