No more family affairs in court
THERE is no local judge whose spouse is a lawyer now that the courts' "one-side-quit" system has been realized, the Shanghai Higher People's Court said yesterday.
In 94 "judge and lawyer" families, one partner had left his or her position to guarantee judicial justice and avoid any conflict of interest, the court said.
Local courts began to implement the system early last year but would help arrange new positions for the partner who had to leave his or her post.
The system was aimed at avoiding any possible injustice or public doubts over cases which could involved a judge and lawyer who were married to each other, judges said.
In the 94 families, most of those who quit had been judges and they had been moved to other departments not directly dealing with lawsuits, the higher court said.
