Payment for paralyzed grandson
A GRANDFATHER has been told to pay his former son-in-law 138,000 yuan (US$22,230) after his grandson was left paralyzed in an accident caused by the elderly man jaywalking.
The father, surnamed Fu, took legal action to help pay for costs for his son, who is now 5 years old, the Chongming District People’s Court said yesterday.
The court heard the grandparents would take care of the boy because both Fu and his wife, whose name was not given, were often working long hours.
But in July 2013, the grandfather, surnamed Zhang, was carrying his grandson in the Pudong New Area when he tried to step over road barriers to cross the road.
Grandfather and grandchild were struck by a car and the boy was left paralyzed from the waist down. Traffic police later said that the bulk of responsibility lay with Zhang.
Fu and his wife divorced earlier this year and the father won custody of his son, whose name was not given.
When Zhang refused to help pay for the boy’s care, Fu took legal action.
Zhang’s wife, whose name was not given, told the court that her husband was also injured in the accident and stopped his own treatment to pay for his grandson’s medical bills.
The guilt he felt led to him contemplating suicide, she added.
The court said those responsible for damaging another person’s health should pay compensation.
