Payout for woman photoed during op
A woman who was photographed while undergoing a minor gynecological procedure has been awarded 22,000 yuan (US$3,500) in compensation following mediation.
The decision was made by the Zhabei District Medical Dispute Mediation Office following a complaint from the woman, surnamed Lin, who underwent the surgical procedure in February 2013.
The hospital, which was unnamed, also issued an apology.
Lin launched an appeal for compensation after discovering that interns who witnessed her surgery had taken photographs of her private parts. She approached the hospital and demanded 100,000 yuan for the loss of dignity and invasion of her privacy.
When her request was denied, Lin visited the hospital with friends and family on June 17. She told officials if she didn’t get her way she would jump off the roof.
The hospital responded by calling the mediation office, which agreed to intervene.
In its defense, the hospital said it was standard practice for interns to observe medical procedures and to take photographs for their reference.
Lin, however, said that she was not told about what would happen and had therefore not granted permission.
As well as paying financial compensation, the hospital apologized and ordered its doctors to delete any pictures taken during Lin’s procedure.
The medical dispute mediation system was introduced in Shanghai in 2011.
