Polluter loses court appeal
A district government’s decision to shut down a concrete company that failed to meet noise and pollution standards has been upheld on appeal, a local higher court said.
Shanghai Qinhui Concrete Co was set up a decade ago in Fengxian, a suburban district of Shanghai, to manufacture and sell concrete. However, in March 2010, the site of the company’s factory was included in a second-level water source conservation area.
Under Chinese water pollution prevention and control law, any construction projects emitting pollutants in second-level conservation areas are prohibited and those that have already been built must be closed.
In December 2012, district environmental inspection officers ordered Qinhui to take measures to curb excess noise and dust emissions.
The company agreed to comply, but its concrete production line was still running as usual when inspectors conducted a check in May 2014. Two months later, a concrete mixing station went into operation on the site without an environmental impact assessment being carried out.
The district government then issued an administrative penalty decision to shut down the operation in February 2015.
