Suit says dad raped his daughter
A SHANGHAI mother is seeking support and medical payments on behalf of her mentally retarded daughter from her ex-husband, who spent several years in prison for raping the girl when she was a teen.
The Songjiang District People's Court conducted a closed hearing on the lawsuit on Wednesday to protect the privacy of the daughter, who is now 27. A verdict was not announced.
The mother, surnamed Chen, said in the lawsuit that she learned in 1999 that the girl's father, surnamed He, had been raping their daughter since 1995 when she was 13.
She said she didn't report the assaults to police until 2003 because she thought it wouldn't be good for the daughter if it became public knowledge and she wanted to give He a chance to reform.
But He spent nights away from home and later moved out. When he failed to make support payments for the daughter. Chen finally called police, according to yesterday's Youth Daily.
A judicial expert in 2003 found that the daughter, who was mentally retarded at birth, suffered from mental illness. Chen said the emotional problems were caused by her rape, although the expert did not confirm the claim.
The father was sentenced to four and a half years in prison in 2003 for rape. According to court records, He said he raped his daughter because Chen had an extramarital affair, an accusation Chen denied.
The couple divorced in July 2006 when He was still in prison. After he was released last year, he filed a lawsuit for his share of the property. The court gave the property, valued at 340,000 yuan (US$49,800), to Chen and the daughter but ordered Chen to give He 80,000 yuan as part of the settlement.
Chen said she couldn't afford to pay He because she had spent all her money to treat her daughter and was 70,000 yuan in debt.
She is suing He on behalf of her daughter for 64,000 yuan in support from 2003 to 2008 and more than 20,000 yuan in medical expenses. She also wants the father to pay 1,000 yuan a month until the daughter regains her health.
