Tour firm ruled to pay over death of man, 82

A Shanghai travel agency has been ordered to pay 55,000 yuan (US$8,120) to the family of an 82-year-old client on a seniors tour who died after waiting alone on a beach for two hours while his fellow travellers went on a sea cruise.

In its judgement yesterday, the Jiading District People’s Court said Changxing Travel Agency had ignored the condition of the man, surnamed Jiang, had not called medical help quickly enough and had not covered his medical costs.

Jiang was one of about 20 seniors on a package our of Jiangsu and Shandong provinces in November last year. He waited alone on the beach because he had not paid for the optional cruise the other customers went on.

After two hours, the party returned and went to the hotel, where Jiang began twitching and speaking with slurred speech, the court heard.

An ambulance was called and arrived about 90 minutes later.

He was diagnosed with cerebral infarction, epileptic seizure, coronary disease and high blood pressure.

At the request of his three sons, he was discharged the following morning and was to be transferred to a hospital in Shanghai, but died during the journey.

Jiang’s sons said their father became ill because he was left on the beach for so long. The travel agency said he had been told of the potential risks and his health was his responsibility.

But the court ruled the agency shared the responsibility.
