Tunnel fall girl compensation
A FOUR-YEAR-OLD girl who sustained a serious brain injury after falling into Fuxing Road E. Tunnel is to receive compensation of about 240,000 yuan (US$36,923), the Huangpu District People's Court ruled yesterday.
The court judged the girl and the driver who hit her and dragged her for a distance after she fell into the tunnel should bear equal responsibility for the traffic accident. China Pacific Property Insurance Co Ltd Shanghai branch, which provided insurance for the driver, should compensate 120,000 yuan and the remainder should be paid by the driver, surnamed Gu. Shanghai Urban Maintenance Management Co Ltd, which manages the tunnel, had no responsibility because pedestrians are banned from the top of the tunnel, the court said.
