US man sues inspection center over Merc damage

AN American expat is seeking 900,000 yuan (US$147,000) compensation after his imported Mercedes-Benz car was damaged during a customs inspection, the Jiading District People’s Court heard yesterday.

The man, surnamed Wang, is suing both the Pudong Entry-Exit Inspection and Quarantine Bureau, which required the test, and the Shanghai Motor Vehicle Inspection Center, which carried it out last December.

According to Wang, the front end of the vehicle was badly damaged during the inspection, though exact details were not released.

The inspection center acknowledged the incident and offered to repair the damage free of charge, waive the 20,000 yuan inspection fee and pay Wang 30,000 yuan compensation.

Wang, however, said the offer was too low as the value of the vehicle on the Chinese market is about 3 million yuan.

In April, the inspection center increased its offer of compensation to 100,000 yuan, while also waiving the cost of repair and the test fee.

Wang again declined and on April 24 filed a lawsuit.

In it he claimed 400,000 yuan for devaluation as a result of the accident, 60,000 yuan to cover nine months’ depreciation and 450,000 yuan to cover the hiring of a lease car.

In the meantime, the center repaired the car and returned it to Wang on August 5.

At the hearing, the center said Wang bought the car in the United States for US$75,500, so had no grounds to be claiming so much compensation.

The Pudong Entry-Exit Inspection and Quarantine Bureau denied any liability in the case.

The court did not make a ruling yesterday, though both parties agreed to pursue mediation.
