Video site link infringed movie maker’s copyright
A LOCAL video-streaming website has been ordered to pay China’s largest state-run film enterprise 100,000 yuan (US$16,300) for linking to an illegal upload of one of its movies.
Bilibili.com was ruled to have illegally provided the China Film Group Corp title “American Dreams in China,” the Pudong New Area People’s Court said yesterday.
Bilibili.com is owned by the Hangzhou Huangdian Science and Technology Co Ltd, a member of the Shanghai Media Group.
“American Dreams in China,” directed by Peter Chan and starring well-known Chinese actors Huang Xiaoming, Deng Chao and Tong Dawei, tells the story of three friends who start a language school.
The popular movie was released in May 17 last year but the China Film Group Corp soon found Bilibili.com linking to an illegal upload.
The Beijing branch of the film group filed a suit to the Pudong court demanding the site stop the copyright infringement and pay 100,000 yuan compensation.
As the link was removed, the plaintiff pursued only the compensation.
Bilibili.com owner Huangdian argued in court that it let users post links but could not check what they posted.
And it had a procedure for infringement complaints, but the film group didn’t inform them, Huangdian said.
But the court ruled that although the movie was not stored in the website’s servers, by hosting a link it helped users commit copyright infringement.
Such behavior “would ruin the rights of the copyright owner and be unfair to other websites,” said judge Xu Fei.
