Wife counters rapist husband's court award
A WOMAN has filed a counterclaim against her ex-husband, who had raped his daughter repeatedly and then persuaded a court that he was entitled to 80,000 yuan (US$11,712) in marital assets.
The 51-year-old woman is demanding support payments and medical expenses for her daughter, who was diagnosed as suffering from schizophrenia in 2003 when her ex-husband was found guilty of raping her and sent to prison, Youth Daily reported today.
After serving four years and six months in prison, the man sued his former wife in May to divide their marital assets. The Songjiang District People's Court yesterday heard the case.
The couple divorced on July 28, 2006 without dividing their assets as the man was still in prison.
That Songjiang court granted the woman ownership of their 340,000-yuan apartment and the right to raise her daughter but told her to pay her ex-husband 80,000 yuan.
The woman who owes 70,000 yuan, then decided to file the counterclaim.
She told the newspaper she discovered her ex-husband had raped her daughter when she was only 13 in 1999 but did not tell the police until 2003 because she did not want this made public.
She lives mainly on her pension – about 1,400 yuan a month, while her daughter is paid 650 yuan monthly by a community charity workshop. Last year her medical expenses amounted to 3,000 yuan.
The two now lived in a rented apartment because the daughter had often harassed their former neighbors when she was suffering from schizophrenia.
The woman also gave up a job at a supermarket to take care of her daughter, according to the report.
Her ex-husband had lost his job and now survived by selling vegetables and driving an unlicensed moped taxi as well as a 400-yuan unemployment allowance every month.
