Woman wins compensation

A WOMAN who fractured her knee after slipping on the floor of a hospital was awarded 86,000 yuan (US$13,500) as compensation from the hospital and the cleaning company.

The Qingpu District People’s Court heard that the woman, surnamed Hu, 52, would visit her father who was hospitalized in late 2013.

On a winter morning in December, Hu slipped and fell on the wet floor of the hospital and injured her knee.

Hu had a surgery at the hospital, which did not bill her for it. But three months after the operation, she still could not bend her knee.

She then demanded compensation from the hospital, which said that if she had been careful, the incident would not have happened.

Besides, it said the cleaning work was contracted to an outside company, and suggested she approach them instead of the hospital.

Hu dragged both the hospital and the cleaning company to court. Both the defendants argued that there was no evidence to prove that there was water on the floor.

The cleaning company claimed there was no evidence to prove its workers were at fault. It said it had also posted signs warning of slippery floors.

But two witnesses told the court that the non-slip mat had been turned over, indicating that the floor was wet, which was why Hu fell.

Also, the court said, it was the hospital’s responsibility to supervise the company, and had to partially take responsibility.

The court also chided Hu for missing the warning signs and for not being careful. It ordered the cleaning company to pay Hu 58,000 yuan and the hospital 28,000 yuan.
