Judge dismissed for handcuffing lawyer to hoop

A JUDGE who handcuffed a lawyer to a basketball hoop under the scorching sun for 40 minutes was removed from the bench yesterday in a county in southwestern Yunnan Province.

The top lawmaker, the Standing Committee of the People's Congress, made the decision against Hong Meng, a judge in Chengjiang County People's Court.

The incident occurred when the lawyer, surnamed He, was representing a defendant in a land dispute case last Friday, according to an investigative report issued by the higher Yuxi Intermediate Court.

Lawyer He found one of his defense suggestions, though denied by the judge, had not been included in the record of proceedings.

He refused to sign the record and added his suggestion to the document himself, which angered the judge.

Hong ordered the court police to remove He from the courtroom and handcuff him to a basketball hoop in the courtyard. He was only released after standing in the hot sun for 40 minutes, according to the report.

"Hong failed to treat the litigant with dignity and ignored by laws before our court. It was egregious and illegal," said the investigative team, according to Xinhua news agency.

He had no comments on the judge's dismissal, yet he has filed an indictment against Hong for insulting him and denying him his legal rights to the Yunnan Provincial People's Procuratorate, which has accepted the case.
