Paper highlights progress in judicial rights
CHINA’S judicial authorities have reformed several areas to improve legal guarantee procedures, according to a white paper issued yesterday.
The paper — “New Progress in the Judicial Protection of Human Rights in China” — issued by the State Council Information Office, said China had revised the Criminal Procedure Law, and implemented the principles of legality, benefit of the doubt and exclusion of unlawful evidence.
Also revised were the Civil Procedure Law, to effectively settle disputes, and the Administrative Procedure Law to strengthen the protection of legitimate rights and interests of private parties in administrative lawsuits. The first Anti-Domestic Violence Law had been enacted to protect the rights of domestic violence victims.
China had also improved procedures for juvenile criminal cases to help underage offenders better reintegrate into society, the white paper said.
Conditions in prisons and detention houses have also been to improved to safeguard the rights of detainees.
Scrutiny of supervisory activities and the execution of punishment will be enhanced, and commutation, parole and execution of sentence outside prison standardized.
Criminal defendants and appellants will no longer need to wear clothing bearing the name of the detention house, so as to safeguard detainees’ dignity, safety, legal property, and rights including the rights to defense, to an appeal, to complain, and to report violations of law, the white paper said.
By the end of last year, psychological counseling rooms had been built in 2,169 detention houses in China, and 2,207 detention houses had provided two-way video via the Internet for those serving their terms of imprisonment in detention houses.
The white paper added that medical services and life management in prisons and detention houses will be standardized to safeguard detainees’ right to health.
According to the white paper, a total of 54,249 people in 40,834 cases of work-related crimes were investigated by Chinese procuratorates last year.
Prosecutors investigated and dealt with 4,490 cases of embezzlement, bribery and misappropriation of funds involving more than 1 million yuan (US$149,710), a year-on-year increase of 22.5 percent.
Some 13,210 people were investigated for taking bribes and 8,217 for offering bribes, and 13,040 civil officials for dereliction of duty and wrongdoing.
From 2012 to 2015, courts at all levels concluded 94,900 cases of corruption and bribery and sentenced 100,200 criminals. A total of 10,300 cases of offering bribes were concluded and 9,219 criminals sentenced.
